legal guardian - September 29th 2012, 07:48 PM

i'm 16 and in college. i've recently been thinking about my brother and how i want to be his legal guardian when i'm old enough. i want to look after him when i'm not in university halls (i'd be 19 and he'd be 16, starting 6th form) but i don't know about the law and all that jazz. i've looked all over the internet but i get different answers.

i want to do this because our parents don't treat us that nicely, but it's not bad enough to call childline or anything like that. i've been so close to running away from home a lot of times but stayed so my brother has me, and i found out a few days ago that he's almost run away too.
where do i stand in all this? what do i have to do? is this a good idea? please help!

Hey Charlie, I'm not sure of the laws in other countries, but regardless of where you live you would need to prove to the court the following:

That you would be fully capable of financially supporting him, this includes clothing, food, shelter, etc.

That you can provide a physically and emotionally healthy environment.

Beyond this, your parents may or may not have to agree and the court would need to understand exactly why your brother would prefer to live with you.
