Moving out of home, what are my rights? - June 14th 2010, 06:49 AM

Hello my name is Sam, I live in Victoria, Australia and I am 14 years of age (15 in Decemeber this year).
Living with my family has been hard for as long as I can remember. I haven't been living at home for the past nine months but my parents decided they didn't want me living with my Grandma anymore and made come home they also pulled me out of my private school and are now sending me to a public school (it isn't that bad but the educations not the best) Mum tells me shes getting me back into the private school.
Everyone in the house fights, my step-dad is always on my back and I cant live with my dad because I dont have anything to do with him. I feel so depressed and lonly being pulled out of my old happy world and now I just sit and do nothing I've even started smoking cigaretees to relax.
My life is literally fucked and I just need some guidance as to what my rights of moving out are. I know I can get a job at the age of 15 (part time) as I would like to complete highschool and eventually go to university.
Where can I live? I despise living at home with my overprotective arrogant parents who have nothing to do with my life and dont do anything for me... I sleep on a mattress for gods sake.
Can I move back to my nans without them saying anything? Can I get a rental myself with a government order ? Can my parents disaprove of this and make me continue to live in there uhappy house. What can I do ? Before it's too late

You have rights who you want to live with but you're also under your mums consent til your 16 or 18 as you're still legally a child (like me) and try asking friends if you could stay with them til you saved enough for somewhere

Well, you just have to try and talk to them again and have a heart to heart so that you can go back to your grandparents' home.

I don't know how it is there, but here, you have to be 16 to be able to legally move out with a guardian over 18. You have to be 18 to move out on your own.

Even if you can get a job and afford rent, you can't legally sign a rent agreement until you're 18 years old, since you have to be an adult to get into a contract.

So, if the laws are anything like they are here, the only way you can get out is if you're in a harmful situation (i.e. being abused), or if your parents give permission for you to move with a member of family.
