Right well my boyfriend started a new job, it's commision based wages but he gets paid £200 a week base wage as well. He's only been there a couple of weeks but he was telling me about this guy at work who's been there for a few months now. He told me that, because this guy hasn't been selling kitchens, they've stopped paying him his £200 a week base wage untill he sells.

I was talking to a good friend of my boyfriend and myself, and he said that what i just described above is illegal. I'm really scared that if my boyfriend isn't very good at this job then this will happen to him, so i want to know is this illegal? And if this happens to my boyfriend will he be able to take legal action? Because i don't think this is very fair at all, especially since the company he works for (Space Kitchens... google it) aren't the nicest and didn't exactly provide the most in-depth training ever, i can't be bothered to go into more detail, but if you research on google you will see why. Anyway, thoughts?

That's also what my friend said. I think i'll get my boyfriend to have a look at his contract at some point, just to be sure. Even if it does say something about it in the contract i still don't think it's fair, people don't just work for the fun of it.

Not fair, however, if it is stated in the contract then they knew it could happen when they took the job.

And to be fair, it sounds like the other guy "isnt" doing his job right, which may lead to him being fired/

How can you tell that? All i said was the guy hasn't been selling kitchens recently, doesn't mean he's not doing his job right maybe it's something to do with the companies Impact-Pressure selling tactics, forcing people to sign on the day which leads to a lot of people cancelling the day after.

At the end of the day people need to earn a living and if they're not right for the job then they should be sacked straight away so they can get onto finding something different, not be fucked around by a company who's sole concern is money and nothing else. And yes i am aware that business is business but with most employers if someone isn't doing what they require of them then they're sacked, non of this 'you won't get paid' nonsense.

Well if he was, he'd get paid, and if he hasn't been paid for some obscure reason your friend would have got a lawyer by now and would be in the process of sueing.

My friend has nothing to do with the company, i was talking to him about it and he said it may be illegal... He's not even employed by them its my boyfriend who is my main concern. I just wanted to know if it was illegal not whether the other guy was doing his job properly.

I think by "your friend" he meant your boyfriends co-worker. I think that sounds REALLY fishy that he isn't being paid a base salary, because I know in the US you need to be paid at least minimum wage for most jobs, but that may be different when it comes to commission biased jobs, I'm not sure. I would have your boyfriend read over his contract, and if it IS in there that depending on sales they can revoke pay, I would suggest that he leave the job as soon as he can find another one, from what I've read of your posts and online this company does not sound like one I'd like to associate myself with.

Sorry i may be having a dippy day, but you've just really confused me Vlora ^^^

I think he's gonna have a read of his contract, he made his first sale last night so he's had a good start. He's been out of a job for 2 years so he really needs this, but if things do start to go bad then he's gonna look elsewhere. He can't just leave because he can't afford to it's taken him 2 years to land a proper job he said that it's just something he's gonna have to do for a little while. It may suck but it's better than being unemployed for another 2 years, right?

You say the friend isn't part of the company but your bf is... meaning your bf is bound by contract and therefore will get paid.
