Train Crash and Roommate Problems - February 3rd 2012, 04:39 PM

Wednesday I was trying to get back to college from my home town. Its a six hour train ride and I normally take the train. When I took the train to my home town 2 weeks prior my train had engine problems was 9 hours delayed and had us all get off the train at a stop 3 hours from my town instead of completing the route. So I did not believe anything bad would happen on the way back, boy was I wrong. So I was asleep on the train and at about 8:20am I got woken up to a loud bang and then saw the first car going off the tracks. I had my phone in my pocket and speed dialed my fiancee because if I was going to die I wanted his voice to be the last I heard even if it was just his voicemail. My fiancee answered around the time the train came to a stop and got angry with me for calling that early until I told him what happened and then he felt like an asshole. I did not realize I was injured but six hours later I was having a hard time walking and had to go to the hospital. I am now in a knee immobilizer and I have to use crutches.

When I got back to my dorm I saw that my roommates stuff was boxed up, I ran into my hall director and asked her if my roommate was moving and my hall director informed me that my roommate reported that there was alcohol in my dresser and I was being written up and fined for it.
Heres the thing: I dont drink.
my fiancee started going to AA after he realized how mean he gets when he drinks and I agreed to stop drinking as well because I am proud of him for what he is doing.
I had just re arranged everything in my dresser before I left and there were no bottles in the room when I left. Meaning that my roommate went threw my drawers planted the bottles and then gave my hall director permission to go threw all of my belongings when I was not there.
They threw out the bottles as well, I offered to pay for them to be finger printed to prove they were not mine.
My roommate and I have been having problems since day one and this is not the first time she has gone threw my stuff, last time it was to get my fish food and kill my fish by emptying the entire container into his bowl.

I have grants and scholarships at the school I am transferring to that I will lose if I can not get this off of my record and I can not afford to remain in college without these grants. The college I am currently at also informed me that because of this alcohol point I am losing my grant for this college begining in the fall so I can not afford to be at this school either.

My roommate reported the alcohol and reported feeling "afraid of sharing a living space with me because of my problems with alcohol" I repeat I dont drink So she is not being fined or anything for this. However I am even though I was several states away.

My RA believes me but I can not get the Hall Director to even fathom that this is what happened, she thinks I am lying and the negotiator for alcohol and banned substance problems wont see me for another week.

I also may be losing my job because I may not be able to work for a few weeks because of my knee.

So basically I may lose my job, even though I have a brand new shiny 800 dollar hospital bill and a visit to a specialist to pay for, I may lose college, though I am the first in my family to go and I am the only member of my family with an ambition other then manager at walmart, and this has basically not been my week.

Hey Samantha
That does sound like an awful week. I am sorry that you had such a bad time.
I hope things get better for you soon.
I was wondering if you could get someone to vouch for your drinking thing? Did you give it up on your own or joined something for it?

First, depending on where you live - most places cannot fire you if you are injured and unable to work due to the injury. Also, depending on your job, they can make accommodations so you can still work while on crutches by giving you a chair or having you switch positions with someone where you will be out of the way and seated but still working.

Secondly, I'm sorry your school is being unfair about this. Technically, they do not have proof except for finding a bottle of alcohol in your drawer. There are too many possibilities it could have been someone else. Don't give up. Fight this. That's ridiculous. Did they decline your offer to pay for fingerprints? I'd suggest going above your Hall Director. Like the Dean? Or even talk to the police and see what they think you could do to prove it was not yours. There has to be a way. It may not be easy, but I really do not think you should just let your roommate get away with this.

And lastly, I'm sorry all of this is happening, let alone all at once. Feel free to PM if you want to talk. And congrats to you and your boyfriend for quitting together

They threw the bottles out so there is no way to prove that they are not mine. And as for quitting alcohol I stopped drinking on my own, I'm a moderate social drinker and I believe I am pretty responsible with drinking so I didnt feel the need to join a support group or anything, I just told everyone I was done drinking and started volunteering to be the sober one who collects car keys at the beginning of the night, and makes the taco bell run at the end of the night. (priviously we drew straws to determine who would be sober) It really hasnt been an issue. And I am appealing the decision my school made to charge me.

Unfortunately, you're going to have to fight the school every single day regarding this. If you step back and hope things will work themselves out, you'll get screwed over. You need to let the school administrators see your indignation regarding this entire ordeal. The school may have eyewitnesses, but they no longer have concrete evidence. They can prove the bottles were in your drawer, but they cannot prove they were yours or that you put them in there; therefore, they cannot prove you are guilty in a court of law. The school, however, does not necessarily operate under the same rules that a court of law would. I've seen schools expel students with very little concrete evidence, and I've seen schools dismiss serious allegations of rape even with a great deal of concrete evidence. The school works on its own legal system, so you cannot assume anything. You need to be aggressive and demand that your voice be heard. Like another member said, go up the chain of command until someone will talk to you. Do this every single day until you are heard.
