Samuel Burgos has fond memories of his friends at school, but he only gets to see them in pictures now.
The 8-year-old boy hasn't been in school for a year and will likely miss another year if the Broward County School Board has its way.
Burgos was suspended from school in November after a teacher found a toy gun in his backpack. But when the boy went to register to go back to Pembroke Pines Charter School, he was told he will be expelled for this school year, too, as part of the county's zero tolerance weapons policy.

School board officials said the rules are quite clear and that the toy gun constituted a weapon. A school board report on the incident mentions that Samuel showed the toy gun to another student and it was capable of firing projectiles.
That's all it takes for it to be considered a weapon.
"This is in his backpack and it's a toy. It's not a real gun. It's a toy," said Magdiel Burgos, twirling a plastic gun.
The school board said they would admit Samuel into a correctional school for problem children who have been expelled located in Hallandale Beach.
The parents refused and believe their son has already paid for his mistake enough. Samuel has since been home-schooled, but his parents want him back in public school.
"I can't sit here and allow them to send my kid to a school where students have committed actual crimes," Burgos said. "He hasn't committed a crime."
Next week, the family will attend a school board meeting to try and get their son back in class as soon as possible, but that could be after Thanksgiving.
Burgos says his child has been set back emotionally and will probably have to repeat the second grade. He thinks there should be some room to determine that his child didn't bring a real gun to school.
"I understand the board is concerned about schools, and as parents we are concerned, too, but they need to work with us," he said.
The school board says it's common sense to know that this kind of item can't be allowed on school campus and that responsibility also falls on parents to know what their children have in their backpacks.

sounds like severe over reaction to me.... makes me wonder wtf this world is coming too...

Yes it's a severe overreaction, but the parents could also put the kid in another school, even private school.If they are homeschooling him, he shouldn't have to repeat a grade. He should be just fine.

You know I just skipped right to reading what you wrote, ignoring the link, and about 3 sentences in I thought to myself, this has got to be in Florida, and then low and behold I was right. God I come from such an idiotic state. Thank God I went to private school.

This is so beyond wrong. I mean if a plastic gun is a weapon, I'm thinking something like a nerf gun, are kids allowed to have scissors any more? What about sharp pencils, when I was in school this guy flicked a pencil at a girl and it almost hit her in the eye and he got in MAJOR trouble. What about belts, those can certainly be weapons. It's freakin ridiculous.

I think the parents should count their blessings that their child is out of the Florida public school system. Hopefully they have enough money to send their child to a private school if need be. I feel bad for the kid though, imagine being 7 and being separated from your friends like that. It's never the same because they see each other all of the time and you miss out on so much and you start to just not fit in anymore, especially at that age.

There's probably not another school in their zone, otherwise I'm sure he'd be in it. And they might not be able to afford private school, it's getting more and more expensive down there. And they are saying he might have to repeat because of emotional reasons, like I said in my above post.

I don't mind the punishment, but the issues is that it doesn't fit the crime.

2 years expulsion for that plastic thing? What is the school board smoking?

He is 8 he didn't know it was wrong and probley just wanted to show his friends he . he should be aloud back

This is a bit ridiculous. Reminds me of a news clip I saw where security guards were checking a baby's diaper for weapons at an airport. While it was crying and his mother was begging them to put him down. This is just so stupid. First of all, I have never heard of an eight year-old shooting anyone. Secondly, it's a freaking TOY. If you put something inside of the gun and fired it, would it hurt someone? Not likely. God, this is just so stupid. Reminds me even more why I think this country has gone to shit.

Two years is alot but I think the expultion was justified.

I don't think expulsion was justified.
Yes it is against the rules, but seeing as it obviously was his first 'offense,' give him detention and/or have a talk with his parents and then see if it happens again.
If it happens again, then more drastic measures can be taken.

here in australia many kids that age bring toys to school and if the teacher feels the toy is innapropiate the teacher just confiscates for the rest of the day and let the parents know that the toy cant be brought back to school i think that its tottally unfair to do that to a 8yr old boy if it was a sling shot even a 2 year expulsion would still be unjustified at 8 years old kids are still learning right from wrong there just kids
