This doesn't make any sense because if the person is waving a gun around with the intent to scare people in order to get something, such as money from a teller and for one reason or another they get a bit too angsty and pull the trigger. Last, your logic would detract people from being police officers because even if they protect a mall of 300 people from 1 crazed gunman, the police officer is still punished. It's pretty much a lose-lose situation. If there were a society built around this logic, it would have the highest murder rate and almost no police because police should explore every single possible angle, even if they are untrained to do so or do not recognize all them, before they make any move of aggression.
