A little legal help? - October 17th 2009, 04:49 PM

I thought this might be the right place for this. So anyways I'm single and I like to flirt with lots of girls, and well a lot of times we exchange pictures, sometimes nude, now I know these girls in real life so I don't need to keep the pictures but if we are both underage, and I have these photos on my computer and cell phone, just for personal use, is this in any way illegal or classified as child porn? I live in Nova Scotia, Canada and the age of consent is 18.

How is it illegal if it's not on the internet, and if they took the pictures themselves and sent them to me? They're only in my documents and not on the internet in any way.

Even if they took them themselves and are not on the internet, just in a file on your computer, you still have pictures of someone who is under 18 which is child pornography.

If you're going to do it then make sure your being safe about it and don't advertise the fact that you are doing it in case someone decides to say something. And if your sending them, again, make sure your being safe about it.

If this puts it into perspective, a 14 year old (I think she was 14 it was in the news a while ago) put naked (maybe only topless?) pics of herself on myspace, and the police arrested her and put her on the sex offenders register for possession of child porn, which I think is stupid, but yep... Its illegal!

EDIT: she was 15 sorry, heres the news link, and I believe later on she did get put on the sex offenders list :/

They're not on the internet right now, but they can be. Someone can easily hack your computer and steal important information (which can be anything from credit card numbers, to child pornography). Possessing child pornography is like wearing a condom...it's safe, but there's no guarantee. What I would do personally is print the pictures up and hide them in a super secret hiding spot. Other than that, there's no such thing as safe. If the FBI or any law enforcement have any reason for hacking into your computer, they will, and you'll be arrested for possessing child pornography if it's on your computer. It's no different than marijuana -- just because the cops don't know about it doesn't mean it's legal. If you get caught, you're fucked.

Yeah it's still considered child porn. That is why you have to be so careful of the pictures you take of your children. I don't even take pictures of them in the bathtub anymore since a couple had their children taken away from it and they were covered up. Things are getting bad and i suggest you delete them after your done with them that way no one finds them.

If I were you, I'd delete them off your computer and cell phone right now. If you MUST have them... print them out and store them in a folder or something... but don't have them on your computer. It is considered child pornography and you CAN get in trouble. Is a little porn really worth being a sex offender? Having that on your resume won't go over so well at job interviews, or applying to college/university...

As everyone else said, yeah, if they are under 18, it is illegal. Just use actual porn for this stuff?

Some teensin America (child porn laws are usually consistant across places in the Western world I believe), were caught with pictures of girls on their phones. The girls sent the boys the pictures, I think they may have even been dating, but they all got in trouble.

Possession of child porn in any way is illegal, whether it's made public on the internet or not.

Now if you keep it for your personal possession, you probably won't get caught as the government won't just randomly assume you have such material but I wouldn't risk it.

I just want to point out that it doesn't matter if they're not on your computer. If they're on your phone, OR printed out, etc, it's STILL legally possesion of child pornography.

I think the printing them out idea is even riskier then having them on the computer. On the computer, you just click delete and they're gone, with them printed out you've got to find a good enough way to hide them and then dispose of them when you're done with them which could mean a even greater risk of being caught with them.

If I was you, I'd just delete them and stick to something else other then sending pictures because you don't want to get caught and like said be registered as a sex offender because that's going to be with you for years to come. Is it worth just a few photos?

even after you "push delete " a copy of it is still stored on your hardrive. get rid of it all imo

Someone who knows what they were doing could, theoretically, still recover the pictures months or years later. So even if you print them off and delete them, they're still there.

With that said, you could always delete them after peinting and use a program that overwrites that part of the harddrive to remove them. Physical copies can be burned. Burning is way more permanent than deleting from a computer (assuming they are completely burned to ashes, and probably crushed up too).

Whatever you do, just be careful. There's a shitload of free porn online, getting on the sex offender list isn't really worth this, is it?
