Bullying victim faces jail for confronting tormentor - March 24th 2009, 06:59 PM

http://cnews.canoe.ca/CNEWS/Crime/20...49691-sun.html

"TORONTO -- Rob Scorcia just couldn't take it anymore. The Georgetown teen had been bullied by the same guy since they first shared a schoolyard in Grade 6, and seven years later, there was still no end in sight.
Only now his tormentor was bigger, meaner and threatening not only his life, but his family's as well.
So Scorcia finally lost it and fought back. But there's no such thing as a bully defence and now he's the one convicted of assault with an imitation weapon and facing an automatic one-year sentence in jail."

I feel for the kid, but what he did was stupid. Threatening anyone with a fake gun is sure to blow up in your face.

Often I lie wide awake, thinking of things I could make.
But I don’t seem to have the parts to build them.
I am so scared of what will kill me in the end, for I am not prepared.
I hope I will get the chance to be someone, to be human.

I feel bad for him, but he handled it rather poorly. He should have only threatened or fought back when under direct harrassment right at that time... then it would have been self defence.

That's just bullshit. The charge against him was using an imitation handgun whilst attempting robbery. Prosecution even admitted to lying about the robbery. How can any juror find against him for threatening this guy after he's been threatened with death several times? That's fucked up, IMO.

Really twisted.
You'd think people would have some compassion for someone who's been persecuted so much and for so long.

Hmm. I do feel a bit sorry for him, but pulling a fake gun, that's just a little stupid. Surely he knows how seriously police will take anything remotely related to a gun..

..and our dreams will break the boundaries of our fears..

I suppose he could have handled it better, but still, I really do feel for the kid... it doesn't seem fair, especially as the bully was threatening him anyways. Poor kid.

I also feel bad for him, but violence is not the way to solve the situation.

Yea you gotta do that in grade school. I pushed an idiot down a flight of stairs after he talked some bs to me. Then I hit another one on the head with a brick because he also bullied me, then his stupid mom called my mom, lol.

Then this little kid was talking crap too so I went after him but his big bro kicked my a$$, threw me a bush of crapiva, sorta like poison ivy.

Then I brought a knife to kindergarten. Anyway, you gotta deal with bullies at a young age while you can still get away with breaking people's bones, lol.

But yea, that kid should have krept up on him and beat the crap out of him.

Wow, this is seriously a miscarriage of law, a miscarriage of justice.

It s preposterous, he surely could of had a defence of duress, even battered wife syndrome the boy terrorized him for a long period giving realistic threats.

why would this boy rob? he is a well to do student. I hope he manages to get an appeal, it will be in the court of appeals then and the judge will apply proper law to him.

This is why I could never be a lawyer.
