Is faking a crime illegal? - November 25th 2009, 08:08 PM

I am just wondering, whether it is illegal or not to fake a a crime?

Not like, wasting police time, but actually the faking of a crime.

I'm actually wondering how you could fake a crime?

If you mean something like murder/ faking a death then yeah it's illegal because you'd get the insurance from the death so it'd end up being fraud.

well without knowing all the details i would say it definitely sounds illegal.

the thing it makes me think of is the whole yelling fire in a public place when there isn't a fire thing. because that is illegal.

and I'd think that if the police get involved that would easily cause problems.
or if you were trying to prank someone they might not find it funny and try to press charges.

It's illegal just like it's illegal to call 911 or the local emergency number when there isn't an emergency.

Peter, were you and Vicki elaborating on the discussion Vicki and I had earlier? Lol. For anyone wondering, we were talking about this story where this woman didn't want to go to work so she sent a ransom note saying she had been kidnapped. They called the police and went to her house, to find that she was there. I think she was arrested.

If you wasted police time then yes it is a crime. Especially if you testified in court about it: That would be perjury.
If you accuse someone of committing a crime when they have not done so then it is slander/libel and is therefore illegal.

Re: Is faking a crime illegal? - November 25th 2009, 11:51 PM

Me and some friends were doing a photography project the other day and got some funny looks doing some scenes which were questionable, in terms of violence, in that way we were acting out a crime, but I don't think that was illegal .

If you don't commit a crime, and don't intentionally waste police time, don't do anything illegal as such, I shouldn't think its illegal, no

when i say it's illegal.. i'm assuming that you report this fake crime to the police and go along with it like it's real.. if like Joel said, it's just acting out a crime with your friends or whatever then obv you're not doing anything wrong.

Yeah, because if you get busted and can't prove you were faking it, then it's considered a crime.
ie if you get by cops and you say "btw we're just kidding", it's obvious that that's not going to fly.

Also if someone calls it in and police come and give you a warning, it goes on your record.

Doesn't faking a crime involve filing a false report? I think it's hard to fake a crime without doing anything illegal.

Yes, I think it's illegal. For example; (this often happens here) some guys are filming and faking they are beating up one of them. Obviously, if you do it in public, some people will try to stop you and/or call the police. Then, you will have problems. Such kind of things.

Faking your own death is illegal, I'm pretty sure faking your own kidnapping is illegal too.

As trivial as it sounds though... If you break a law, you've done something illegal, if you don't break a law, you haven't. Faking a crime will only be illegal if you commit a crime in the process xD

If you break the law while faking the crime then yes it's illegal. If you report the crime as if it were a real crime, then that is also illegal. If you try to fake, say, using a toy gun to rob a store, then that is illegal because the store owner doesn't know you're joking around, especially if you take whatever items or money. Likewise, if you make a suicide look like a murder, then that's illegal also. The consequences of what the crime is that you faked will vary but even simply calling the police over something that's not an emergency is illegal because they're out thinking you're in harms way just to find that you're not while other people probably are but they cannot deal with them yet since they're out dealing with whatever it is you did.

Faking a crime is wasting police time. Plus it's providing false evidence, fraud etc etc.

If you act out a crime in a movie or a play etc it's not but if it gets to be reported to the police by anyone, then you've probably broken the law.

I think he was meaning, not the wasting police time part Maybe you mean't that in reply to another post though

This question reminds me of that whole balloon boy thing, which makes me think that yeah, if the police were involved in the 'crime' then you would be wasting their time and can get a big penalty for that. Calling 911 without an emergency is illegal, so faking a crime and getting them involved for no reason would definitely be illegal.

If...

1) You cause commotion by doing whatever

and 2) The police show up because of said commotion (whether fake, real, make-believer, whatever)

... Chances are they will find something to charge you (or whoever) with.

I did mean to reply to OP Joel I just didn't word what I meant very well ... essentially if you fake a crime there's a pretty high chance the police will be notified by somebody. Like Amanda said, calling in an emergency without there being one is illegal. So if you cause enough concern (by faking the crime) for someone to alert the police ... you could be done for wasting police time.
