A woman is suing McDonald's after she claims that she was permanently injured after the toilet seat detached, causing her to fall.

No offence to anyone, but judging from circumstances, and that it happened in McDonald's it was probably her who broke the toilet seat.

Sorry but it just sounds unbelievable.. Toilet stalls are pretty small and the toilets aren't that far off the ground so if she did fall, she'd fall into the stall wall which wouldn't be that far away and if she hit the floor, yeah she'd cause herself some damage but not enough to permanently injure herself.

It all seems a little bit over the top just to get some money out of them. Unless I'm missing something.

As much as I hate McDonald's food and corporate practices, this lawsuit sounds incredibly frivolous. I would hope that it's either dismissed or lost by this woman.

Look, if the seat broke due to not being maintained/fixed properly by McDonalds and she really did sustain injuries then she deserves to recover damages. Simple. Just because it was a small distance to fall does not mean she wasn't hurt. For example, I know someone who has severe permanent spinal problems from missing a chair when she sat down. Injuries can be disproportionate to the act that caused it; in much the same way that some people can get a railway sleeper all the way through their brain and live relatively unscathed people can lapse into a coma and die from a small bump on the head, it all depends on how lucky or unlucky you are.

It may be an attempt to get money through frivolous legal action or it might be a serious case and frankly we do not know enough of the story to decide one way or the other.

Yeah, that pretty much covers what I was going to say too. Without more information, we really don't know whether this is just a get-rich-quick attempt or whether there is a genuine cause of action here.

On another note, this is reminding me of a lot of the more ridiculous sounding Tort cases I had to study for my degree, which Jack can probably sympathise with...

I'm always interested when I read of cases involving damage to the nervous system especially if it covers other parts of the body. However, I'm trying to get my head around what she could have done to damage her CNS (brain and spinal cord) in such a way that it results in this. I can only think there was a small distance between the toilet and the wall so her back became like a broken bridge allowing for her to collapse. But the article doesn't seem clear if the injury was due to the impact on the CNS or if it was when she tried to break her fall/shoulder and elbow hit the wall and floor. Obviously it could very well be both but if it does involve the CNS, there's research showing how stroke patients who result in some parts of their body being paralyzed can regain movement and full use without medications. It seems so quick for her to say she's "permanently disabled" regarding her shoulder and elbow area. I'm interested in this because some of it seems a bit off. From the sounds of it, she hurt herself by reaching and falling against the wall, so I wonder what is the "shock to the CNS"?

I don't study law but I wonder, if she broke the toilet seat resulting in this, would it not be her fault, assuming the facility was up to standards on all the safety?

That's happened before. Google it, some woman sued them for not warning her the coffee was hot.

Anyways. I think that it's really easy to just say that people shouldn't sue for every little thing--however, as Jack said, if someone did sustain serious injury (and by serious, I mean injury that prevents them from working or going about their everyday lives) then it seems reasonable to sue them. The damages could pay for the hospital visit or whatever that was needed to treat the injury.
Oh, and on a related note...I would KILL to see a video of this.

As long as 1) McDonald's was truly to blame (for not properly maintaining the bathroom toilets) and 2) she's not tacking on an additional $10,000 for "emotional distress" (as in, $30,000 covers the medical costs + compensation for lost time at work), I have no problem with her suing McDonald's.

She must have been moving about a fair bit for the seat to just fall off...
And like others have said, it's a bit early to say she's "permanently" disabled. Honestly, I can't see this case going very far based on the information given.

McDonalds purposefully failed to maintain its toilet just so that woman could injure herself. They got her addicted to burgers so her weight would also inevitably overwhelm the support the toilet was assured to give. They also sprayed the toilet seat with WD-40 to make it easier to fall off it, under the pretence that it makes no.2's easier. I have classified information of this stored up my ass. She has every right to sue the s*** outa them. She's right, WE'RE ALL WRONG.
